 New Amendments regarding Transfer of a Worker to another Employer in Saudi Arabia


The Minister of Human Resources and Social Development in Saudi Arabia, Ahmed bin Suleiman Al-Rajhi, approved to amend the executive regulations of the labor system, with regard to the transfer of an expat worker from one employer to another, reports Umm Al Qura newspaper.



The new amendments clarified the conditions that must be met in each case for an expat worker want to move to another employer.

1. Amending Paragraph (1) of Clause (2) of Article (14) which read the following: 

An expatriate worker may transfer to another employer without requiring the availability of a specific period in case the current employer agrees, unless the rules stipulated in the establishment incentive program to localize jobs (Nitaqat) Otherwise. 2. Amending Paragraph (7) of Clause (Second) of Article (14) which read the following:

An expat worker may transfer to another employer upon the expiry of the documented work contract without the consent of the current employer.

3. Adding a paragraph No. 21 to Clause Second of Article 14 to read the following:

Subject to the provisions of Article (77) of the system, an expat worker may transfer to another employer without requiring the approval of the current employer when the following conditions are met:

A. That he had spent 12 months from the date of his entry into the Kingdom. Recommend : 3 Amendments to apply in Saudi Labor Law to be effect from 14th March 2020

B. For the worker to notify the current employer no less than (90) days before the move before terminating the contractual relationship, unless the two parties agree otherwise.

- This decision shall be published in the official gazette and on the Ministry's website, and shall be enforced as of March 14, 2021.

- This decision cancels all previous decisions that contradict it. Read : Employer can able to cancel Exit Re-Entry of Expat issued by him through Absher

- The Deputy Minister for Labor must take the necessary steps to inform and implement this decision.
