An Employee has right to claim an End of Service Gratuity upon termination of his work contract


The consultant of the Human Resources in Saudi Arabia, Majed Al-Quait confirmed that, if the worker's contract ends, he or she is entitled to claim an end of service gratuity, referring to cases in which the employer has the right to terminate the employee's contract.








While speaking with Al-Ekhbariya, Al-Quait said that, if the employer asks the worker to submit the resignation and worker is able to proved that, this is considered as dismissal and then the worker is entitled to an end of service gratuity.

- There are several reasons for termination, either there is a violation of the employer or the employee is in violation, the termination of the contract, reaching the age of contract or closing the project and in this case the employee is not entitled for compensation, but he is entitled for end of service gratuity and the disbursement of vacation balances, the rest is in addition to an experience certificate. - According to a legal advisor, Malak Al-Fadl, the employment contract is a contract between employer and employee to complete a specific work in return for an agreed upon wage.





- She said, one of the most important points that must be met in the employment contract and mentioned in the Law in Article 52 is to write the name and address of the employer, the name and nationality of the worker, in addition to writing the salary, benefits, allowances, duration of contract and the joining date.

- The employer must stick and follow after signing contract and he must set the wage and provide health insurance to the worker, he must register him in social insurance (GOSI) and provide paid annual leave.
