Does working on Foundation Day requires employee Compensation? HR Ministry response


A company asks its workers to work on Saudi Foundation Day and Human Resources interact :

The Ministry of Human Resources and Social Development in Saudi Arabia interacted on a complaint about the a company in the private sector which refused to give its employees the foundation day holiday, restating that the Saudi Foundation Day (February 22) is an official holiday for the public and private sectors in the Kingdom.







The ministry also stated that the Saudi Foundation Day is on February 22 of every year, and it is an official holiday for all workers in the public and private sectors."

- In response to an inquiry from one of the user, the official account of Ministry of Human Resources customer care said that, “All working hours performed on holidays are considered as overtime, and the employer must pay the worker an additional salary for the additional working hours, It is equivalent to the hourly salary plus 50% of his basic wage, as per the Article 107 of the Saudi Labor Law.

- The Custodian of the Two Holy Mosques and Saudi Arabia's King Salman bin Abdulaziz, issued a royal order on January 27, specifying that February 22 of each year will be a day to commemorate the founding of the Saudi state, called “Foundation Day,” and it becomes an official holiday. HR Ministry amends Work system regulation regarding Foundation Day holiday :

- The Ministry of Human Resources and Social Development (MHRSD) has amended the work law regulation regarding Saudi Arabia Foundation Day holiday. The minister of MHRSD, Ahmed Al-Rajhi announced in a statement that the ministry has amended the executive regulations of the labor law.

- The Ministry's decision stipulated an amendment on Paragraph 4 of the clause and 2 of Article 24 to be as,

"The National Day or Founding Day with the holidays for one of the tow Eids does not compensate the worker for this day". See Also : Is Hajj pilgrimage on Business visa possible?




- It means that, the worker will not be compensated if one of the two Eids, Eid Al-Fitr and Eid Al-Adha overlaps with the National or Foundation Day.

- The Ministry also amended by adding Paragraph number 4 of the Clause 1 of Article 24, to be as,

"The Founding Day holiday lasts for one day, on 22nd February of the Gregorian calendar". Saudi Expatriates app
