SENDING DEAD BODY OF SAUDI EXPATRIATE TO HOME COUNTRY

After following the "procedure for expatriate death in KSA", Dead body's home country Embassy will approve (NOC) whether the body has to send home country (Non Muslims & Muslims) or bury in the land of Saudi (Only Muslims).





NON MUSLIM EXPATRIATE DEATH IN SAUDI ARABIA :

It is important to mention here that solely Muslims may be buried in Saudi Arabia. If some non-Muslim dies in Kingdom of Saudi Arabia, his body must be sent back to his home country. So as to move the dead body, a death certificate from Saudi Arabia Authorities is needed. Moreover, Embassy permission is additionally needed during this regard. it's the responsibility of the sponsor of the dead body to require care of all the executive processes and bear the burden of value attached it.

SENDING BODY (DECEASED PERSON) TO NATIVE COUNTRY:

If body has to be repatriated to the home country, sponsor ought to move to Jawazat and surrender the Iqama to urge Final Exit visa.





- Required documents has to be present for sending the body to home country.  Deceased person's (Passport, Entry Visa, Iqama, Death certificate in English, Written Address of family in Arabic, Approval from Embassy, Medical report in English, Copy of Power of Attorney from heir in Arabic signed and by Notary Public, Police report copy (If un natural death), Letter from sponsor regarding dues).

- All Arabic documents should be attended with Associate in Nursing English translation certified by the Embassy. PROCEDURE TO FOLLOW FOR DEATH OF ANY MUSLIM OR NON MUSLIM EXPATRIATE IN SAUDI ARABIA

If an expatriate dies in Saudi Arabia, his relatives or friends must follow this following procedure whether he is a Muslim or Non Muslim.





- In case of death, Whether it is in home or in any road traffic accidents in Saudi Arabia. First step, one have to follow is to call 999 for the local police and to call 997 for ambulance at that location. Police will process its report and ambulance will do its own responsibilities to repatriated the body to hospital morgue.

- If the dead body is already in hospital then you need not to call for ambulance and police. Mainly, one should inform the sponsor as he is the only legally responsible to execute all the processes including bearing the cost of repatriation to home country. Hospital with handover all the belongings of dead body to his sponsor including four envelops addressing





1. One envelope for The morgue in the Hospital.

2. One envelope for the Passport Office for Final Exit Visa.

3. One envelope for the Airport Cargo Office (If body is sending to home country).

4. Last envelope for Saudi Customs Office ( If body is sending to home country).

- Sponsor should go to Ministry Of Health (MOH) and submit the reports of hospital and police to get the death report. Then sponsor should handover this death report including passport and Iqama copies to Ministry Of Interior (MOI) to get legal death certificate. After this sponsor will contact Embassy (Deceased person native Country Embassy) to get approval either to bury in Saudi or to transfer the body to home country. Once he get NOC from Embassy, he will process to bury the body in Saudi Arabia.

CORRECT YOUR NAME ON SAUDI IQAMA

If you are a new Saudi Expatriate and you received your iqama or muqeem card (residence permit in Saudi Arabia) for the first time, Then it is necessary to double check your Iqama/Muqeem name. Confirm, it is same as your passport name and the Arabic name pronounce same as English name. 





It is possible for few expatriates their name is little different (Incorrect) while comparing in passport or English and Arabic. But it is not accepted, You should change it and make it same as your passport. Your Iqama or Muqeem is not acceptable if the names are different whether it may be little or more than little.

- Banks will not accept your Iqama whether it is at remittance centers (while sending money to home country) or banks (while opening bank account in Saudi Arabia). As per SAMA (Saudi Arabia Monetary Authority) guidelines your Iqama will not be accepted if it is incorrect at your name.

- You will not get any Police Clearance Certificate from Saudi Arabia as your passport name is different from your iqama. Police Clearance Certificate is very useful while you are migrating for work to European countries. What to do if your Iqama Muqeem have Incorrect name?

You should go to your HR officer or government relation officer of your company and request him to change your iqama name as it is wrong.

3. If you do not have passport (As your passport is with kafeel) you need to apply for urgent (Emergency) passport from Embassy or Consulate. Which is only valid for one way exit from Saudi Arabia to your home country.





4. Once you get your emergency passport you will be sent for finger printing in deportation center. Once your finger printing finished they will arrange your documents to exit under huroob status. If everything goes smooth you will be deported to your home country from Saudi Arabia without jail.

Huroob will be imposed by sponsor or employer on employee iqama number if he is absent from work for a specific time. 1. Request your sponsor or employer to invalidate "Run Away" or "Absent from Work" report against you. If your sponsor satisfied with you he can approach passport authorities and submit documents to invalidate runaway report against you. For that he need to submit the required documents like

- Form for invalidating runaway report.
- Runaway report.
- Statutory fees
- Presence of Sponsor or his representative.

2. Approaching to Labor court for seeking remedy against illegal huroob. Normally deactivation of an escape report is not possible in this case once your employer made it. If you feel your huroob status is illegal you can approach it to labor court. But as you are runaway and illegal in huroob status, you cannot approach to labor court alone, You need to take a help of embassy or social workers and a known lawyer to submit a proof against your sponsor as he made illegal huroob against you.





3. Surrender to Jawazath, In this way you have to surrender yourself to authorities at Tarheel centers, Who will arrest you and keep you in jail and then deport you to your home country with a ban of 5 years from entering Saudi Arabia.

Huroob is an Arabic word which means Escape or Absconder or Run Away (Absent From Work). - 5000 SR for first time, 10,000 for second time and 15000 for third time including one month imprisonment.

- Runaway employee shall be deported at employer's expense or if he was working for his own he shall be deported on his own expense.
Sometimes employers (sponsors) may misuse Huroob provision, If an employee is going to approach against employer in labor court for any causes like mistreatment, non payment of salary or any other causes.





According to Saudi Labor Law, "An employer (sponsor) may not terminate the employee contract without an award (To him), advance notice or indemnity except in the few cases, and provided that he gives the worker a chance to state his reasons for objecting the termination."

Vacations, Holidays and leaves under Saudi Labor Law 2015 for Saudi Expatriates working in the kingdom of Saudi Arabia. You can also Refer English translated Saudi Labor Law.





ANNUAL LEAVE :

As per Saudi Labor Law, Employees are allowed to have Twenty One(21) days paid annual vacation. If your employer's employee contract is less than this, You can request it to increase to 21 days.
SAUDI LABOR LAW 2015 LEAVES VACATIONS

If you are with same employer since 5 years you are entitled for 30 days paid annual vacation. If your employer is not following this, He is violating Saudi Labor Law (Article 109.1). However you can apply for vacation only after completing 2 years of employment with your current sponsor.





Every employee in Saudi Arabia should avail for vacation leave during the years it is due. If employee does not do so, Its employer decision to give him leaves for future years or forfeit the benefit.

Vacation and Leave Policy under Saudi Labor Law
SICK LEAVE :

An employee whose sickness has been proven is allowed to take 4 months sick leave from sponsor (Employer). As per this condition, Employer cannot terminate him from job or remove him from employee payroll. To apply this condition, Employee has to submit doctor certification stating the number of the days employee need to rest. Without doctor medical sick leave certificate, It is discretion of the employer.It is allowed to employee to add his annual vacation leave with the sick leaves. Implemented Yearly basis quota is as follows.

- First 30 Days, Fully PAID.
- Next 60 Days, 3/4 of Total Wages
- Next 30 Days, UNPAID.

DEATH IN THE FAMILY:
As per Saudi Labor Law (Article 160), In case of death of Wife or any other blood relation (Father or Mother or Sister or Brother or Daughter or Son) employees are entitled for 5 Days paid leave (As per new amendments in SLL 2015, Earlier it was 3 Days). For female employees, She is entitled for 4 months 10 days Iddah leave.





HAJJ LEAVE :
If an employee is performing Hajj, He is allowed for 10 Days paid vacation. As one can perform Hajj only once in five years with same employer. Employee is required to complete 2 years with same employer to avail this benefit.

MARRIAGE LEAVE :
Employees can get 5 days(Updated Oct.2015, Earlier it was 3 Days) paid leave for marriage, Once in his tenure with employer. Suppose, If you request for two weeks marriage leave. Three Five days will deduct from marriage leave and remaining from your annual leave.

MATERNITY LEAVE :
According to Saudi Labor Law (Article 151 to 156), A female employee is allowed 10 weeks vacation in case of delivery of child. Before delivery date, Four weeks for maternity vacation and 6 weeks vacation after delivery of child, which is fully paid. Probable delivery date shall be decided by the Doctor in written statement. Employer cannot terminate her or remove her from payroll of company. She can also add annual leave to the maternity leave if she wants, She can add extra one month leave which is unpaid, After 10 weeks of vacation. Employer should provide her one hour extra rest compare to other staff to feed her baby.





These vacations may or may not be fully paid. Decision is on number of years she worked with company quota as follows.
- FULLY PAID, 3 Years or More.
- HALF PAID, 1 Year or More
- UNPAID, Lessthan 1 Year.


Male employees can also avail of 1 day paid leave to attend to newborn child.
EID-UL-FITR & EID-UL-ADHA:
According to Saudi Labor Law ( Article 112), Employees are allowed to have 4 Days paid vacation, From 30th of Ramadan for Eid-ul-Fitr. And another 4 Days paid vacation, From 9th of Zil Hajj for Eid-ul-Adha.
NATIONAL DAY :
Saudi Arabia National Day is celebrated on every 23rd of September. All employees are granted one day paid holiday for National Day of Kingdom of Saudi Arabia.





NOTE FOR DOMESTIC WORKERS : Above mentioned leaves are not applied for Visas sponsored by Individual Saudis to work at home, Household Workers and Drivers. Domestic workers are entitle one month paid leave for 2 years and one day off every week.

- Visa holder have 3 months of time to travel once visa issued, If failed to travel, A fine will be imposed, So make sure to Cancel if you are unable to go.
